In recent weeks, we have encountered individuals who themselves or someone close to them are suffering from domestic violence in silence. One of the biggest issues we discovered was that most of them were unaware as to what qualifies as domestic violence in Malaysia. To address this issue we thought perhaps we can try to simplify the qualifier and set out the 7 conducts which can be considered as Domestic Violence in Malaysia.

What is Domestic Violence in Malaysia?

It is a form of abuse that commonly occur in a domestic setting specifically in a marriage or familial relationship! Abuse does not only entail physical means, BUT also INVOLVES mental and emotional abuse.

In Malaysia, domestic violence are governed by Domestic Violence Act 1994 (DVA) which aims to protect victims of domestic violence.

Who are the potential victims of Domestic Violence?

Here is the list:

  • his or her spouse;
  • his or her former spouse;
  • a child;
  • an incapacitated adult; or
  • any other member of the family;

7 conducts which may be considered as domestic violence in Malaysia?

  1. Placing the victim in fear of physical injury
  2. Causing physical injury to the victim
  3. Forcing victim to engage in non-consensual sexual activities
  4. Confining the victim at a place against his/her will
  5. Causing destruction or damage to victim’s property with the intention to annoy or cause distress to the victim
  6. Causing psychological abuse which includes emotional injury to the victim
  7. Causing victim to suffer delusions by using intoxicating substance without the victim’s consent

The list above is not exhaustive, these are some of the examples of actions that can amount to domestic violence.
